This Procedure is developed on the basis of the Federal Law No. 135-FZ dated 26 July 2006 "On Protection of Competition" (Collection of Legislative Acts of the Russian Federation, 2006, No. 31 (part I), article 3434; 2007, No. 49, article 6079; 2008, No. 18, article 1941; No. 27, article 3126; No. 45, article 5141; 2009, No. 29, articles 3601, 3610, 3618; No. 52 (part I), articles 6450, 6455; 2010, No. 15, article 1736) (hereinafter-The Law on Protection of Competition) and is used to analyze the state of competition in order to establish the dominant position of an economic entity (entities) and identify other cases of preventing, restricting or eliminating competition, including:
а) when considering cases of antitrust laws violations
б) when making decisions within the framework of state control over economic concentration in accordance with Chapter 7 of the Law on Protection of Competition, with the exception of considering transactions and other actions that are carried out within a group of persons;
в) when deciding on the compulsory separation (spin-off) of commercial and non-commercial organizations engaged in entrepreneurial activity, in accordance with article 38 of the Law on Protection of Competition.
